1. Definitions

a. Treasure Emporium means the business trading as Treasure Emporium (ABN 34 636 513 654), an online retailer based in Australia.
b. Products means the goods listed for sale on this website.
c. Customer means the person placing an order via this website.
d. Contract means the agreement for the sale and purchase of Products incorporating these Terms.

2. Sale & Purchase

Treasure Emporium agrees to sell, and the Customer agrees to purchase, the Products in accordance with the Contract.

3. Orders & Formation of Contract

a. All orders are subject to acceptance by Treasure Emporium.
b. A binding Contract is formed when we send an order confirmation to the Customer.
c. We accept orders for delivery to Australian addresses only. Customers must be aged 18 years or over.
d. We may limit quantities or refuse orders at our discretion.

4. Price & Payment

a. Prices are as displayed at the time of ordering.
b. All prices are in Australian dollars and include GST (if applicable).
c. Shipping costs are shown at checkout.
d. Accepted payment methods are displayed at checkout.
e. We may update pricing or products at any time without notice.

5. Delivery

a. We arrange delivery using reputable carriers.
b. Delivery timeframes are estimates only. To the extent permitted by law, we are not liable for delays caused by carriers or events outside our control.
c. Any transit damage or tampered packaging must be reported within 2 business days of delivery.

6. Acceptance

Unless you notify us within 7 days of delivery that the Products do not match your order, the Products are deemed accepted.

This clause does not limit your rights under Australian Consumer Law.

7. Title & Risk

Ownership passes once full payment is received. Risk passes on delivery to your nominated address.

8. Limitation of Liability

a. To the extent permitted by law, we are not liable for indirect or consequential loss arising from the use of our Products.
b. Nothing in these Terms excludes your rights under Australian Consumer Law. Where liability may be limited, we may choose to:
i) replace the goods
ii) repair the goods
iii) cover the cost of replacement or repair

9. Changes to Products

We may update, change, or discontinue Products at any time.

10. No Resale

Products are sold for personal use only and must not be resold without written consent.

11. Force Majeure

We are not responsible for delays or failures caused by events outside our control.

12. Returns, Exchanges & Warranty

❌ Change of Mind

We do not offer returns or exchanges for change-of-mind purchases.

⚠️ Faulty or Damaged Goods

If your item is faulty, not fit for purpose, or not as described, you are entitled to a remedy under Australian Consumer Law.

Please contact us within a reasonable time and provide:

  • Order number

  • Description of the issue

  • Photos or video evidence

🛠️ Warranty

We provide a 12-month warranty from the date of purchase against defects in materials and workmanship.

This warranty is provided in addition to your rights under Australian Consumer Law.
